1. Acceptance of Terms

By accessing or using Audiopanzer ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Audiopanzer ("we," "our," or "us").

2. Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years of age to create an account. If you are under 18, you must have parental or guardian consent to use the Service.

3. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Use the Service to infringe upon the intellectual property rights of others
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the Service or servers
• Use automated means (bots, scrapers) to access the Service without our written consent
• Resell, redistribute, or sublicense the Service without authorization
• Generate content that promotes hate speech, violence, or discrimination
• Use the Service to create misleading or deceptive content

4. Content Ownership and License

4.1 Your Content

You retain ownership of the prompts and ideas you provide to the Service. For content generated by the Service (stories, audio, etc.), you are granted a non-exclusive, worldwide, royalty-free license to use, modify, distribute, and display the generated content for personal and commercial purposes, subject to your active subscription.

4.2 Our Content

The Service, including its design, features, code, and documentation, is owned by Audiopanzer and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

4.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, you grant us the right to use them without restriction or compensation.

5. Billing and Payments

Paid subscriptions are billed in advance on a monthly or annual basis. By subscribing, you agree to:

• Pay all fees associated with your chosen plan
• Authorize us to charge your payment method on a recurring basis
• Provide accurate and complete billing information
• Update your payment information as needed to avoid service interruptions

Prices are subject to change with 30 days' notice. We may offer promotional pricing that is subject to additional terms. All prices are in US dollars unless otherwise stated.

6. Cancellation and Termination

You may cancel your subscription at any time through your account settings. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will not be charged for subsequent billing periods
• Your access to premium features will end at the close of the billing period
• Your generated content will be available for download for 30 days after cancellation

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay fees when due.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORYFORGE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to use) the Service
• Any conduct or content of any third party on the Service
• Unauthorized access, use, or alteration of your content
• Any errors, inaccuracies, or omissions in generated content

Our total liability for any claims under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT GENERATED CONTENT WILL BE ACCURATE, ORIGINAL, OR FREE FROM ERRORS.

10. Indemnification

You agree to indemnify and hold harmless Audiopanzer and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a prominent notice on the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Delaware.
